General Terms and Conditions
Overview
Welcome to Expo Habesha! The terms "we", "us", and "our" refer to the Expo Habesha shop, owner Tsegai Tesfai, Peterstraße 23-25, 50676 Cologne (hereinafter "Expo Habesha"). Expo Habesha operates this online shop and website, including all associated information, content, features, tools, products, and services (the "Services"). The shop is operated on the Shopify platform.
The following General Terms and Conditions ("GTC") apply to all orders you place through our online shop. Please read these GTC carefully before placing an order. By submitting an order, you accept the version of these GTC valid at the time of the order. Our Privacy Policy informs you about the handling of your personal data.
Section 1 | Scope and Customer Base
Our offer is exclusively for consumers residing in the delivery area (see Section 6) and who are of legal age when ordering. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. Sales to entrepreneurs, for commercial resale, or for export are not made. You warrant that your purchases are for your personal use or household use.
To use the Services, for example, to place an order or create a customer account, certain information is required, such as your email address, as well as billing, payment, and shipping information. You warrant that all information you provide in our shop is accurate, current, and complete. You are responsible for the security of your login data and for all activities in your customer account.
Section 2 | Our Products
We display our products in the online shop as accurately as possible. Colors and appearance may differ from the display on your screen depending on your device and its settings. Product images may also include serving suggestions. For food products, the mandatory information on the respective product page and on the packaging of the delivered product is decisive. Please always check the information on the packaging if you have allergies or intolerances.
Individual images in our shop, especially mood, banner, and category images, may have been created with the support of artificial intelligence; such images are marked as AI-generated symbolic images at the respective place. They serve for illustration and do not represent a guaranteed quality of the goods.
We may adjust our product range at any time and discontinue products. We reserve the right to set household-typical quantities per order.
Section 3 | Conclusion of Contract
The presentation of the products in our online shop does not constitute a legally binding offer, but an invitation to order. By submitting an order via the order button, you make a binding offer to conclude a purchase contract for the goods contained in the shopping cart. The purchase contract is concluded when we accept your order by an order confirmation via email or by shipping the goods. An automatically sent order confirmation only documents that your order has been received by us and does not yet constitute acceptance. Should we not be able to accept your order, we will inform you and immediately refund any payments already made.
The contract language is German. The contract text is not separately stored by us; you will receive the order data with the order confirmation by email. Please check your order carefully before submitting it.
Section 4 | Prices and Payment
All prices in our online shop are final prices in Euros and include statutory VAT. Additional shipping costs incurred will be shown in the order process before placing the order; details are regulated in our Shipping Conditions. For goods offered by weight, volume, or length, we indicate the basic price per unit of quantity. Price changes, discounts, and promotions are not retroactive; the price displayed at the time of the order is decisive. Separate conditions may apply to promotions, which we will indicate as part of the promotion.
Payment is made via the payment methods offered during the ordering process, currently including credit and debit cards (Visa, Mastercard, American Express, Maestro, UnionPay), Apple Pay, Google Pay, Klarna, and PayPal. For individual payment methods, the conditions of the respective payment service provider may additionally apply, particularly for Klarna, its terms of use for the chosen payment option. You warrant that you are authorized to use the chosen payment method and provide accurate payment data.
Section 5 | Delivery, Shipping, and Transfer of Risk
Our Shipping Conditions apply. Delivery times are estimated. For consumers, the risk of accidental loss and accidental deterioration of the goods passes to you or a person authorized by you to receive the goods only upon handover of the goods. Please report obvious transport damages to us as soon as possible; your statutory rights remain unaffected.
Section 6 | Delivery Area
We deliver exclusively within Germany. International delivery is currently not available. Alternatively, you can pick up your order at our store in Cologne (Click & Collect); details can be found in the Shipping Conditions.
Section 7 | Alcoholic Beverages and Youth Protection
We sell alcoholic beverages only to persons aged 18 and over and deliver them exclusively within Germany. By ordering alcoholic beverages, you confirm that you are at least 18 years old. We and our shipping service providers are entitled to demand age verification upon delivery and to refuse delivery if it is not provided.
Section 8 | Retention of Title
The delivered goods remain our property until full payment of the purchase price.
Section 9 | Right of Withdrawal
Consumers have a statutory right of withdrawal. Details, exceptions (especially for perishable goods and unsealed hygiene articles), and the sample withdrawal form can be found in our Withdrawal Policy.
Section 10 | Warranty
Statutory warranty rights apply. If the delivered goods are defective, you can, within the framework of the statutory provisions, demand supplementary performance, withdraw from the contract, or reduce the purchase price, as well as claim damages if applicable.
Section 11 | Liability
We are liable without limitation for damages resulting from injury to life, body or health, in case of intent and gross negligence, in case of fraudulent concealment of a defect, in case of assumption of a guarantee, and according to the Product Liability Act. In case of slight negligence in the violation of essential contractual obligations (obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance you may regularly rely), our liability is limited to the contract-typical, foreseeable damage. Otherwise, liability for damages caused by slight negligence is excluded.
Section 12 | Intellectual Property
All content of our services, in particular texts, images, graphics, logos, and their arrangement, are the property of Expo Habesha or our licensors and are protected by copyright and trademark law. You may use the content exclusively for your personal, non-commercial use. Any further reproduction, distribution, or public display requires our prior written consent. Shopify's name, logo, and product names are trademarks of Shopify.
Section 13 | Prohibited Uses
You may use the Services only for lawful purposes. Prohibited uses include, in particular: violations of applicable law or third-party rights, the transmission of false or misleading information, the uploading or transmission of malicious code, the automated reading of the Services (e.g., by scrapers or bots) without our consent, the circumvention of security measures, and any conduct that interferes with the use of the Services by others or could harm Expo Habesha, Shopify, or third parties. In case of violations, we may block access to the Services; your rights from already concluded purchase contracts remain unaffected.
Automated or semi-autonomous software ("Agents") may only access the Services if they identify themselves as an Agent in each request (User-Agent identifier "Agent/[Agent name]"), do not conceal their Agent status, in particular do not fill in or bypass CAPTCHAs or similar protective measures, and respond truthfully when asked whether an interaction originates from a human or a computer. We may technically restrict or prohibit access by Agents.
Section 14 | Relationship with Shopify
Expo Habesha is operated on Shopify, which enables us to provide you with the Services. All sales and purchases you make in our shop are, however, directly with Expo Habesha. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Expo Habesha, including any injuries, damages or losses arising from the purchase of products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or in connection with your purchases and transactions with Expo Habesha.
Section 15 | Data Protection
All personal data we collect through the Services is subject to our Privacy Policy. As the Services are hosted by Shopify, Shopify also processes personal data regarding your access to the Services; details can be found in our Privacy Policy.
Section 16 | External Links and Third-Party Tools
Our Services may contain links to third-party websites or tools. We have no control over their content; their terms and privacy policies apply. Please check these before conducting any transactions there.
Section 17 | Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
Section 18 | Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you, as a consumer, have your habitual residence in another country, mandatory consumer protection provisions of that country remain unaffected by this choice of law.
Section 19 | Severability Clause
Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall replace the invalid provision.
Section 20 | Amendments to the GTC
We may amend these Terms and Conditions for future orders at any time. Your order will always be subject to the version published in the shop at the time of the order. The current version can be viewed on this page.
